9015 – Nepotism

A. To the extent permissible by law, and in accordance with the requirements of any applicable collective bargaining agreement, no person shall be appointed to, or promoted into, a position in the District in which the person to be appointed or promoted would:

i. have the authority to appoint, remove, discipline, or evaluate the performance of the other; or
ii. be responsible for auditing the work of the other; or
iii. be placed in a situation of actual or reasonably foreseeable conflict of interest, if the applicant is an immediate family member as defined below.

B. This policy will apply on a prospective basis only; i.e. only with regard to promotions or appointments made after the effective date of the policy.

C. This policy shall apply to all full time or part time appointments.

D. The requirements of this policy shall be subject to exception, in the event that the Superintendent recommends, and the Board determines that the best interests of the District would be served by an exception being invoked.

E. For the purpose of this policy “immediate family member” is defined as parent, spouse, domestic partner, child, stepchild, sibling, step-parent, grandparent, and grandchild.

F. The Superintendent of Schools may also investigate as appropriate, when it appears an appointment may result in a conflict of interest, because of the relationship between a proposed appointee and direct supervisor, even though the direct supervisor is not a member of the proposed appointee’s immediate family.

G. Current staff and members of the Board of Education, to the extent they are aware, must disclose either to the Superintendent of Schools or to the President of the Board of Education if an immediate family member has applied for employment in the School District. The Board of Education is to be informed immediately of all such disclosures.

H. All candidates for hire are required to disclose any family relationships as defined above.

I. School personnel in a hiring position are expected to recuse themselves from the hiring process of any immediate family member.

J. All positions will be posted using the District’s website, and/or other online recruiting tools.  All postings will include directions on how to apply for the position. 

K. All hiring managers will adhere to the District’s hiring protocols which will include the listing of all candidates selected for interviews by a hiring manager.  Principals will keep a list of candidates selected for internal school positions (ex. Department Chair) and made available to the District’s Human Resources upon request.
